Contracts
As part of the State of the State Address delivered on 26 September 2006, the Premier announced the introduction of a policy to change the presumption in relation to confidentiality clauses in contracts entered into by the Crown. Confidentiality clauses will not be permitted in future contracts unless it is in the public interest. The Premier also announced that:
- any contracts that include clauses exempt from this policy are to be reported on the Tenders Web site; and
- contracts valued at more than $2 million are to be made publicly available.
The Policy does not apply to:
- a contract in existence as at 15 February 2007;
- a novation of a contract which occurs as a result of a contractual entitlement to novate in existence as at 15 February 2007;
- a procurement that has commenced prior to 15 February 2007;
- information protected under the Personal Information Protection Act 2004 (Tas) or the Privacy Act 1998 (Cwlth); or
- contracts of employment under the State Service Act 2000.
This policy is effective from 15 February 2007.
In accordance with this policy this Department has an obligation to publish contracts with a value exceeding $2 million on appropriate website. Refer to the Crown Contracts Confidentiality Policy and Treasurers Instruction 1402.
Details of all procurement contracts over $50,000 appear on the Department of Treasury and Finance website including the contracts where the value exceeds $2 million. Procurement contracts relate to goods and services; and building and construction projects.
